Our client was involved in a multiple car collision while driving on I-75 in Hillsborough County near the city of Ruskin. He was driving a Ford Taurus 2012 model in one of the slower lanes of traffic on I75.
The front driver in the collision had a tire blow out and the driver behind him was not able to stop in time. This caused the Truck driver to swerve out of the way of the second vehicle to try to avoid the collision. Unfortunately, this caused the truck to spin out of control and ultimately spin into our clients car.
The photograph shows the severe impact to our client’s vehicle and he was very lucky to survive the crash. He went to the hospital following the accident and then went through months of medical treatment with physical therapy and pain management injections. When he still had pain even after this treatment, he was ultimately given a surgical recommendation to have neck surgery.
Our client however did not want to have surgery and did not in fact have any surgical treatment.
The law also only holds someone responsible for the harm they caused. The trucking insurance company defended on the fact that they were not the cause of the tire blow out. Had the tire not blown out in the first place then the accident might not have happened. We however argued that the truck still had the ability to prevent the damage to our client had he not been following the second vehicle so closely.
This is why it is always important on the highway to make sure to engage in safe driving practices to avoid collisions. Every driver has a general duty in the state of Florida to drive as a reasonable person would.
